The decision of the obliged entity to reject the application may be appealed within 15 days from the date of delivery of the decision to the entity that issued the decision.

The obliged entity shall submit the appeal together with the file to the superior authority within 15 days from the date of receipt of the appeal. The higher authority shall decide on the appeal within 15 days from the date of submission of the appeal by the obliged entity. The time limit for the decision on the appeal shall be 15 working days from the date of receipt of the appeal by the obliged entity. The time limit cannot be extended.

In a judicial review of a decision on an appeal on the basis of an action under a specific legal provision, the court shall examine whether there are grounds for refusing the application. If there are no grounds for refusing the request, the court shall annul the decision on appeal and the decision of the obliged entity to refuse the request and order the obliged entity to provide the requested information.


Complaint

The applicant may lodge a complaint about the procedure for handling a request for information (hereinafter referred to as "complaint"):

  • who disagrees with the handling of the request by reference to the published information,
  • who has not been provided with information or submitted a final licence offer after the expiry of the 15-day deadline or the deadline extended by 10 days for serious reasons, and a decision has not been issued rejecting the application,
  • to whom the information was provided in part without a decision to refuse the remainder of the request,
  • who disagrees with the amount of the payment notified to him in writing or with the amount of the remuneration for the authorisation to use the information requested in connection with the provision of the information.

The complaint may be lodged in writing or orally with the obliged body within 30 days of the date of receipt of the communication on the manner of handling the request or the date of expiry or extension of the time limit for providing the information. The obliged body shall submit the complaint together with the file to the superior authority within 7 days of the date on which the complaint was received. The superior authority shall decide on the complaint within 15 days of the date on which it was submitted to it.
